These are valid feelings, but it's important to separate concern from the practical and regulatory realities.

The National Electricity Rules: The Guts of the Matter Now, to the core of the issue: the National Electricity Rules (NER). These rules govern the National Electricity Market (NEM), which covers Queensland, New South Wales, the ACT, Victoria, South Australia, and Tasmania. Western Australia and the Northern Territory have their own separate regulatory frameworks, but the general trend towards smart meters is similar.

Under Chapter 7 of the NER, there's a clear directive for the rollout of smart meters. Specifically, when a metre needs replacing โ€“ whether it's faulty, at the end of its life, or you're installing new solar or making a significant connection change โ€“ the replacement must be a smart metre. There's no opting out in these scenarios. Your energy distributor is obligated to install a smart metre to ensure the grid can operate efficiently and accurately.

Victoria was an early adopter, with a mandatory state-wide rollout completed years ago. In other NEM states, the rollout has been more market-led, driven by retailers and distributors upgrading infrastructure. However, the underlying rule remains: if a metre needs to be installed or replaced, it will be a smart metre.

Smart Meters and Your Solar System For solar homeowners, smart meters aren't just an option; they're often a necessity. Older, single-direction metres simply can't accurately measure the bidirectional flow of electricity โ€“ both what you import from the grid and what you export to it. So, Can You Actually Opt Out? The short answer, in most circumstances, is no. The NER effectively mandates this.

There were some historical provisions, particularly in NSW, where consumers with a functioning older metre could actively refuse a proactive smart metre upgrade initiated by their retailer or distributor. However, these "active refusal" mechanisms are becoming less relevant as the rollout progresses and older metres naturally reach their end-of-life or become incompatible with evolving grid requirements. The trajectory is towards a universal smart metre network across the NEM. Refusal in situations where a smart metre is required can ultimately lead to disconnection of service, as your distributor needs a compliant metering system to provide electricity safely and accurately.

Understanding Your Rights and Embracing the Benefits While "opting out" is largely not an option for new or replacement metres, you do have rights. You have the right to clear information from your energy retailer and distributor about the installation process, the benefits, and how your data will be used. If you have concerns, you can contact your energy ombudsman scheme in your state or territory.
